Here is how to avoid them: #1: Your Product Hurts Someone (Or Property) & They Sue You For Damages If your product hurts someone, then they could potentially sue you for damages. This is particularly relevant in the USA which doesn’t have a public healthcare system, and the USA is the biggest online marketplace for Amazon. This is why Amazon requires that, if for 3 months, your sales exceed $10,000 in revenue, you are required to get insurance for at least $1,000,000 in coverage. Prior to this though, Amazon does not require you to get insurance. The easiest way to safeguard yourself against getting sued for this is to avoid products that are a potential risk. Anything that includes blades, heating elements or sharp edges is going to have a higher risk over simple items (the example used in this video of a “simple item” is a headphone case). This also has the advantage that insurance for “simple items” is going to cost less than for riskier items. If you start out with a simple, less risky item, you’ll also be able to lower the cost of insurance for future “riskier” items by consolidating insurance (the more items you have insured, the cheaper it usually is to insure them as there is a discount). #2: Your Product Contains Trademarks or Copyrighted Images When manufacturing and importing products from China, you are going to have access to a lot of products containing copyrights and trademarks. In the video, the example used is that on Alibaba there are a lot of different items containing Mickey Mouse (the character is protected under both copyright and trademark law). Unfortunately, a lot of people make the mistake of thinking that because companies are producing and selling these items, that they have the right to do so. This is not the case. They aren’t producing/manufacturing because they have the right: they are doing it because they know that they can usually get away with it. Internationally, copyrights are usually honoured. China has also agreed to honour them. However, they are rarely enforced which is why infringement is so rampant (despite being illegal). The reason it is so rarely enforced is because culturally in China, if something is easy to copy and distribute to the masses, this is considered a good thing to do. In the West, the cultural perspective is different: we view that the rights of the individual are more important. So do not import items breaking copyrights/trademarks. Your products will be taken down off of Amazon, and you are risking having legal action taken against you. #3: Your Products Violate Patents Something interesting about patents is there is no such thing as an “international patent.” While countries will usually agree to honour copyrights, there is no protection for trademarks. You need to file your Patents in each individual country. This means that Chinese manufacturers regularly product items that are protected by patents in other countries like the USA. In the video, an example of a product that is patented in the USA is one by Wigzi. It has patented dual dog leashes that contain the following features: * Has the leashes attached to a rotating wheel that is separate from the handle (to stop the dogs getting tangled). * Has individual triggers for each leash, so you can control the length for each one. * Has the leashes colour-coded to match the colours of the triggers. There are several manufacturers on Alibaba that are producing dual leashes that have these exact same features. And as there is no active patent for this style of dog leash in China, they are allowed to sell them. But if you were to import them to the USA and sell them on Amazon.com it would be a big mistake as Wigzi would get your listing taken down, and could potentially sue you. When conducting product research, look to see if there are any other similar items on Amazon listed. If the item has unique features and there are no other products like it listed, there is a good chance that it is patented. You can then go to the website owned by the company listed as the seller and see if they have any patents on their site. Usually, they’ll have them listed very clearly. You can then go to Google patents and check to see if the patent is still active.

Historically, patents could only cover the technological aspects of a new insurance invention. This is still the case in most countries. In the United States, however, recent court decisions have encouraged more inventors to file patent applications on methods of doing business. These patents may be used to get more comprehensive coverage of improvements in basic insurance processes, such as the methods of calculating premiums, reserves, underwriting, etc. This is causing controversy in the insurance industry as some see it as a positive development and others see it as a negative development. An early example of an insurance patent is U.S. Patent 467,872 Means for Securing Travelers Against Loss by Accident. This patent was issued in 1892. It discloses a means for selling travelers' insurance by combining coupons with a newspaper. A more recent example of an insurance patent is EP application 0700009, granted as EP 0700009B "Individual evaluation system for motorcar risk". This patent issued by the European Patent Office in 1996 to Salvador Minguijon Perez. It discloses a means for auto insurance risk selection whereby a driver’s mileage and driving behavior are monitored and insurance premiums are charged accordingly. The United Kingdom part of this European patent has been sold to Norwich Union insurance company. Historically, only about one or two patents per year issued in the US on inventions specifically related to insurance policies. This changed dramatically, however, with the 1998 State Street Bank Decision. The State Street Bank Decision was a ruling by the Court of Appeals for the Federal Circuit that confirmed that there was no “business method exception” under United States patent law. The number of patent applications filed per year after this decision was handed down jumped to about 150. The number of patents issuing per year jumped to about 30. In September 2006, Lincoln National Corporation filed a patent infringement lawsuit against Transamerica Life Insurance Company and other entities for allegedly infringing U.S. Patent 7,089,201, “Method and apparatus for providing retirement income benefits”. This patent covers methods for administering variable annuities. The jury found the patent valid and infringed. The court ordered Transamerica to pay Lincoln $13 million in damages. At a rate of 11 basis points of assets under management, this was considered a reasonable royalty. In June 2010, however, the verdict against Transamerica was overturned on appeal In June 2010, Progressive Auto Insurance filed a patent infringement lawsuit against Liberty Mutual over one of Progressive’s Pay As You Drive auto insurance patents. Some in the insurance industry see the growth in insurance patents as a positive development. They cite that by being able to protect inventions, insurance companies will be more inclined to invest in new product development. Some are concerned that the growth in patent claims will be negative. They are concerned that invalid patents will issue and that this will lead to patent trolls inhibiting new product introductions by demanding excessive license fees for these questionable patents. Inventors can now have their insurance U.S. patent applications reviewed by the public in the Peer to Patent program. The first insurance patent application to be posted was US2009005522 “Risk assessment company”. It was posted on March 6, 2009. This patent application describes a method for increasing the ease of changing insurance companies to get better rates.

New assurance products can now be protected from copying with a business method patent in the United States. A recent example of a new insurance product that is patented is Usage Based auto insurance. Early versions were independently invented and patented by a major US auto insurance company, Progressive Auto Insurance (U.S. Patent 5,797,134) and a Spanish independent inventor, Salvador Minguijon Perez (EP 0700009). Many independent inventors are in favor of patenting new insurance products since it gives them protection from big companies when they bring their new insurance products to market. Independent inventors account for 70% of the new U.S. patent applications in this area. Many insurance executives are opposed to patenting insurance products because it creates a new risk for them. Sometimes this tax deferral is the only reason people use these products.[citation needed] Another example is the legal infrastructure which allows life insurance to be held in an irrevocable trust which is used to pay an estate tax while the proceeds themselves are immune from the estate tax.

Growth on the cutting edge is all about the creation of new ideas. So, we want institutions that incentivize such creation. How do we do this? The answer is somewhat tricky. The first goal for good ideas is for them to spread as freely as possible. The further the reach, the greater the gains. The problem is, if just anyone can use ideas, then why would we ever pay for them? And without the right incentives, why would innovators create new ideas at all? Imagine yourself as the creator of a new drug. Typically, it costs about a billion dollars to do this, not counting the time and effort needed, to get the drug FDA-approved. Now, if there were no protections in place, then theoretically, once the formula’s known, everyone could just copy the make-up of your new drug. See, the thing about pharmaceuticals is, once the formula’s known, production is relatively cheap. Given that, let’s assume imitations start flooding the market. Predictably, the price of your new drug will plummet. Once prices hit rock-bottom, you’ll have no way to recoup the $1 billion you spent on R&D. Given that kind of result, we reckon you probably won’t want to develop more good ideas. The US founding fathers anticipated this problem. Knowing that innovators needed incentives to have good ideas, the founders wrote a protection mechanism into the Constitution. They gave Congress the ability to grant exclusive rights to inventors—rights to use and sell their inventions, for a limited period of time. This exclusive right, is what we call a patent. Patents grant inventors a temporary monopoly over the use and sale of their intellectual property. Now, as nice as this is, patents are a thorny subject. For one, how long should patents last? Also, how much innovation is considered enough to merit a patent grant? Not to mention, are patents the only way to reward good ideas? The answer is no. There are two more incentive options here: prizes, and subsidies. Let’s start with subsidies. University and research subsidies are particularly effective in the basic sciences. Since innovations in this space are rather abstract, subsidies incentivize research without requiring the applications of the research to be explicitly named. The problem is, when we’re incentivizing just research, then researchers might pick directions that are interesting, but not particularly useful. This is why the third incentive option—prizes—exists. Prizes reward the output of solving a certain problem. Another plus, is that prizes leave solutions unspecified. They provide a problem to work on, but give quite a lot of leeway as to how the problem is solved. Now, knowing the complexity inherent in patents, you might think that prizes and subsidies are good enough alternatives. But none of these incentives for ideas, are inherently better than any of the others. Patents, prizes, and subsidies all involve their own tradeoffs and questions. For example, who decides what gets subsidized? Who decides which goals merit a prize? It’s hard to determine what mix of institutions, will best incentivize the production of good ideas. Patents, prizes, and subsidies all navigate these conflicting goals, in their own way. And yes, all this talk of incentives and conflicting goals and tradeoffs might be like walking a tightrope. But, it’s a tightrope we can’t opt out of. Certainly not if we want the economy to keep growing. Houvener, your host of the Bold Today Show, where you, the inventor or entrepreneur, get your daily inspiration, so that you can go make the world a better place. All right, we’re talking about IP, intellectual property, insurance. And it’s a five-part series, this is the third session. Yesterday we talked about the first type of insurance policy that you can get if you’re going down the process of getting a patent. And that’s patent infringement policy, meaning when you get that patent granted, as we talked about yesterday, you’ll have the ability to have coverage for paying your attorney fees and court costs, if there are any, for going after a would-be infringer. Today, we’re going to talk about just the opposite. Let’s say you’ve gone down the initial step of doing a patentability search with your attorney. Let’s say it’s a Bold Patents attorney. And through diligence and effort and searching, unfortunately, the answer comes back saying, “Look, we don’t recommend that you file. We think there’s already something that’s been out there and been published on this, and we don’t think you can get a patent on this specific invention, all right?” But you still love it, it’s still your passion, and you want to pursue it in the marketplace. The next question that you would probably want to ask is, “Hey, if I go start making and selling this out in the public, am I likely going to be sued? And will I be sued meritoriously?” Meaning, will I really lose and be at a disadvantage, and will I be ceased from moving forward with my business? So that question would normally be addressed under what’s called a Freedom to Operate Opinion. And those are quite extensive, expensive, and time-intensive. So the main issue there is that, for the inventor, or the business owner, rather, at this point, they decided not to file their patent or seek an application. They want to simply move their product into their market, but they want to be able to have some protection. And so that’s what this insurance is for, so through a third-party broker, we introduce the business owner to a broker that can help provide a policy on patent defense policy. And so a patent infringement suit against them, they will be able to use the coverage to help hire legal counsel to defend against infringement. And they’ll be able to, of course, begin with attacking the validity of the accused patent, going after the fact that “Hey, I’m not really infringing,” whatever the case may be, but it’s the ability for that business owner to stay in business, to actually be able to afford that litigation. Captive insurance companies may be defined as limited-purpose insurance companies established with the specific objective of financing risks emanating from their parent group or groups. This definition can sometimes be extended to include some of the risks of the parent company's customers. In short, it is an in-house self-insurance vehicle. Captives may take the form of a "pure" entity (which is a 100% subsidiary of the self-insured parent company); of a "mutual" captive (which insures the collective risks of members of an industry); and of an "association" captive (which self-insures individual risks of the members of a professional, commercial or industrial association). Captives represent commercial, economic and tax advantages to their sponsors because of the reductions in costs they help create and for the ease of insurance risk management and the flexibility for cash flows they generate. Additionally, they may provide coverage of risks which is neither available nor offered in the traditional insurance market at reasonable prices. They don't seem to understand how trademark works, nor do they care that their practices are illegal. Follows is the email they sent me. For legal advice, please contact a lawyer. Question 1: Will you get sued if you use product images from Aliexpress suppliers? The answer to this is almost certainly no. In China, the culture around copyright is very different to the western world. In China, the culture around copyright is that if something can be easily copied and can benefit others, then that is more important than protecting the rights of a single individual. It is a cultural difference. As a result, it’s very easy to get away with piracy in China, which is why pirated movies/music/games are sold freely on the streets. In fact, Chinese manufacturers copy each other all the time. Not only do they produce the same products, they steal images from each other. If you go to Aliexpress you will see that different manufacturers are producing the same items, and they are using the same images. As a result, it is extremely unlikely that any Aliexpress supplier would try to pursue you in court for any copyright issues. If they were going to sue anyone - it would be the manufacturers that are copying them - although due to the cultural differences, that is also extremely unlikely. If you’re still worried, you can contact the Aliexpress suppliers and ask them if they are OK with you reusing their images. Question 2: How Can I Avoid Being Sued for Copyright Images? They might not care in China if you copy images - but in the west, they sure do! Even if your website is not making any money, you can still be pursued legally and sued for using images without permission - so it’s very important that you don’t use copyrighted images on your website! A good place to find images you can use is with Google Images: 1) Go to Google Images 2) Click settings. 3) Click advanced search. 4) Type in what you’re searching for. 5) Scroll down to usage rights. Select “free to use, share or modify, even commercially.” 6) Click search. You’ll be surprised at how many images you’re allowed to use! So don’t get lazy and use images that are copyrighted. Use Google to find free images you’re allowed to use. Question 3: Can I Sell Aliexpress Products that are Trademarked? No - do NOT sell products that are trademarked. For example, in the video, Sarah compares two items - one that is a generic self-stir mug, and one that is a self-stir mug with Harry Potter imagery on it. Do NOT sell the Harry Potter mug, as it is illegal. If you sell products with trademarks, you aren’t just risking getting sued - you’re risking having legal action taken against you.

Licensing is just one way and there are pitfalls and benefits all inventors, entrepreneurs, start ups or early stage companies must be aware of? David Postolski will discuss these issues as well as the anatomy of a license agreement as will other ways to monetize and commercialize your IP including patent brokers, auctions, enforcement through litigation, non practicing entities, universities and private equity funds. OHIM (the Office for Harmonization of the Internal Market, somtimes just called the EU Trademark Office) offers a service called TMView for conducting a trademark search. https://www.tmdn.org/tmview Not only the EU member states but also other countries and offices such as the WIPO, US (USPTO) and Korea are contributing their data to this handy database. You can click on Advanced Search and then enter the name of your new product. You can also limit your search with many other criteria such as the classes for goods and services. One very interesting feature is the possibility to also search for similar trademarks. Lets use an example: we want to lauch a new line of t-shirts under the name of marimba. So we enter marimba in the trademark field. We also want to limit the search to class 25 for clothing. Also, we could add classes 18 for bags, 14 for jewellery and 35 for retail services, since these are sometimes considered similar. And then we check the checkbox called Fuzzy. We cold in theory limit the search to particular offices. After submitting the search we are presented with all the similar trademarks in class 25. Your patent attorney is liable for what he says and if your are successfully sued by an owner of,an earlier mark, the insurance of your patent attorney may cover for the damage in case he said that he does not expect any issues with this particular trademark. Also, experienced trademark professionals will know the relevant caselaw when two trademarks are considered too similar.
