Created by the Hennepin County Bar Association's New Lawyers Section and StoryBoard Films. During 2014-2015, the New Lawyers Section wanted to explore how the level of student loan debt carried by attorneys was impacting their lives--both personally and professionally. As part of the HCBA's 2015 Membership Survey, a number of questions dealing with the topic of law school debt were included in order to gather information from local new lawyers about this issue. After seeing the results of the survey, the section wanted to share these findings in an meaningful way to create greater awareness among the bar about: The current state and extent of law school debt among new lawyers, and to show its impact on the legal community and profession, overall. We hope the video above is a conversation starter among all attorneys--from the newest to the most senior--about how the cost of law school is affecting this generation of lawyers and will continue to impact the future of the profession. After watching this video, we hope you will discuss the issues presented with your colleagues and coworkers. How do you think the legal community should address this issue? Jeffrey Lipshaw is Professor of Law at the Suffolk University Law School in Boston, where he teaches contract law and courses in the business curriculum. He writes on contract theory, corporate law, and business judgment, with focus on the overlap between business and legal decision-making. He is particularly interested in the theoretical and practical implications of having been trained merely to “think like a lawyer” when confronting uncertainty and making decisions in business transactions. He is the author of Beyond Legal Reasoning: a Critique of Pure Lawyering (Routledge, 2017), and a co-author of the casebook, Unincorporated Business Entities (LexisNexis), and the ABA publication, Becoming a Law Professor. His articles have appeared in peer-reviewed journals such as Law, Culture, and the Humanities, the Canadian Journal of Law & Jurisprudence, and the Journal of Law & Religion. In addition, he has published in the Minnesota Law Review, Illinois Law Review, University of Cincinnati Law Review, Penn State Law Review, Seton Hall Law Review, Connecticut Law Review, Southern California Interdisciplinary Law Journal, Delaware Journal of Corporate Law, Temple Law Review, and other student-edited journals. Professor Lipshaw was a founding co-editor of the Legal Profession Blog, an inductee in the ABA Journal’s Blawg 100 Hall of Fame. He was also a co-editor, with William Henderson and Jerry Organ, of The Legal Whiteboard, a blog about trends, facts, and ideas in law and legal education. He is a frequent guest blogger on PrawfsBlawg. Before becoming a full-time academic in 2007, Professor Lipshaw spent twenty-six years as a lawyer and business executive, most recently serving as Senior Vice-President, General Counsel, and Secretary for Great Lakes Chemical Corporation, a Fortune 850 company based in Indianapolis, Indiana, and listed on the New York Stock Exchange. There he counseled the company’s Board of Directors in its compliance with Sarbanes-Oxley and NYSE governance requirements, led the company’s efforts in significant acquisitions and dispositions, and managed a law department with an internal and external annual budget of over $10 million. Professor Lipshaw began his career in 1979 at the law firm of Dykema Gossett in Detroit, where he was a partner in the litigation and corporate groups, and served from 1993 to 1997 as the Vice President & General Counsel of AlliedSignal Automotive, a large auto parts manufacturer. Before coming to Suffolk, he was a visiting professor at the Wake Forest and Tulane law schools. He is a 1976 graduate of the University of Michigan, and a 1979 graduate of the Stanford Law School. He lives in Cambridge, Massachusetts with his wife, Alene, and their dog, Tia.

July 2 (Bloomberg Law) -- Jay Grushkin, hiring partner at New York's Milbank Tweed, talks with Bloomberg Law's Lee Pacchia about how the hiring season has changed since the recession in BigLaw began in 2008. Elite law schools have moved their on-campus recruiting weeks earlier and earlier, in efforts to give their students the best chance at getting a job. That's forced firms to extend job offers faster than before the recession began. He'd like to see recruiting move from August to January of a student's second year, so firms have a better sense of their business needs.

His company, DoNotPay, has built an AI-powered chatbot that interviews users about their legal problems in plain English and then uses their answers to complete and submit legal paperwork on their behalf. Browder describes DoNotPay as "the world's first robot lawyer," and believes that the system he's building will one day be able to address the majority of legal issues. "DoNotPay will have succeeded if the word 'lawyer' is completely removed from the dictionary for average people," Browder told Reason. The 21-year-old entrepreneur from the UK, who taught himself to code by watching YouTube videos, lives and works with his eight-person team out of the same Palo Alto house that Mark Zuckerberg rented during his first summer in California building Facebook. Browder says the legal industry is so ripe for disruption through software because most services involve nothing more than standardized processes and boilerplate language. DoNotPay initially focused on fighting parking tickets because Browder views them as an unfair tax on the poor. He says DoNotPay has succeeded in overturning citations about half the time, saving users $16 million in fines over its first three years. Now, operating on just over $1 million in venture capital funding, the start-up is expanding to cover a broad range of legal problems. DoNotPay's app, which is in development, will monitors users' accounts and gets them money back whenever the law allows. It can automatically rebook plane tickets when prices drop, request refunds when banks charge illegal overdraft fees, and help users reclaim security deposits from shady landlords. Browder says DoNotPay will never charge for any legal services, and he doesn't need much cash to continue expanding and thus has time to figure out a revenue source. This allows the company to serve clients who can't afford to hire lawyers, such as refugees seeking asylum and homeless people applying for public housing in the UK. DoNotPay is also working on a service that helps navigate the US visa process. "These processes are so bureaucratic that if you have no resources at all, it really is impossible to get the help you need," says Browder. And as long as lawyers have an incentive to keep laws complex and their services expensive, he thinks it will take a bottom-up approach to make the system fair. DoNotPay has built bots that can query automated email, chat, and telephone systems thousands of times to, for example, get users a quick appointment at the DMV. Browder calls this tactic "DDoSing the legal system to make it better." Beyond helping his users navigate bureaucracy, Browder hopes to flip the script by making legal complexity more of a pain for governments than for average people, and thereby incentivize lawmakers to slash red tape in general. "There's a $200 billion legal industry at the moment," Browder says, "and DoNotPay will hopefully one day make it free for everyone." Why Lawyers Are So Depressed

Lawyers will be much more fulfilled if they do some public service, suggests Kramer. Question: Why are lawyers the most depressed professionals? Larry Kramer:  So I think a large part of that comes from exactly the things that we've been talking about.  Which is, people have been, you know, making job choices, early career choices, that are not really well suited for them.  And then getting into jobs with the idea that they'll just do it for a couple of years, make a lot of money, pay off their debt and then find something that they like.  But what happens too often is, it's actually really hard to go from making $200,000 a year to making $100,000 a year.  So they don't make the move out once they've been in it for a couple years and suddenly they're locked in a career that isn't really satisfying to them. A big part of that is our fault, the law school's fault, because, as I say, we've always done much too little to really help them think about their choices while they're in school and we've made it easy for them to just follow this path.  So, you know, so we need to reduce that, I think we need to help people actually while they're in law school, you know, find their way to a career within the law that will be fulfilling. It's not the practice of law, as I say, the practice of law is great.  It's fascinating, you get to work with amazing people, you get to do important things, you get to help people in a big way.  So it's just a question of helping people find that part of a legal profession that does that for them and we haven't done enough of that and I think too many people have done too little. Now, there's two other aspects to this, though.  One is, for what it's worth, I think the reports are somewhat exaggerated.  We've been doing our own research on this and actually there's a study that's just come out called, After The JD and After The JD 2, and the levels of satisfaction among legal professionals are much higher than a lot of the other studies or anecdotal reports would have you think.  They're still not as high as they ought to be, but it's, I think, not quite as bad as conventional wisdom now holds.  And then the second thing is, you know, there's also a large amount of evidence that suggests that if you can find a way to make public service a part of your career, you'll have a much better career.  And so this is something else that I think the law schools have to take on.   We've taken this on as one of the central tenants that we try and give students in their three years there, which is some exposure while they're in school to some form of public service, whether it's, you know, a pro bono practice full-time work, government work, whatever it is, you know, we say to them, "You come to law school, you're going to get a license to practice law.  It's a really powerful thing in this society, you can do a lot of, a lot of things with it.  Now you're going to make a choice what kind of career you want to have and we don't have, you know, it's not our judgment about that, you should make your own choice, there are a lot of different careers in law, you have to find something that seems to suit you, but whatever practice you choose, whatever kind of law you choose to go into, there's room in it to do public service.  And that will be both good for the community, but will also, you'll be much more fulfilled in your career if you do it.  And so we try and model for them the different ways to do it, we try and do a lot to help students find their way into that, even the ones who are not going to, you know, become full-time public interest lawyers, it doesn't matter.  All right?   There's still ways to do this and we'll try and help you and that will increase career satisfaction as well.  Recorded May 5, 2010 Interviewed by Jessica Liebman
